Immigrant visas are necessary for those wanting to live in the U.S. long term. 

To acquire an immigrant visa, you must either: 

  • Be a U.S. citizen or lawful permanent resident and sponsor an eligible family member
  • Or receive sponsorship from a U.S. citizen or lawful permanent resident

The types of family members who may be eligible for an immigrant visa include:

  • Immediate relatives, such as spouses, unmarried biological and adoptive children under 21, and parents. The U.S. does not limit the number of visas it grants to immediate relatives.

Key Requirements for Fiancé Visas

You can bring your fiancé to the country to get married through a K-1 (fiancé) visa

To be eligible for this type of visa, you must:

  • Have citizenship
  • Intend to marry your fiancé within 90 days of their arrival
  • Be legally free to marry your fiancé (i.e., you and your fiancé have successfully terminated any previous marriages) 
  • Have met your fiancé at least twice in person within two years of making your petition

The process of securing a K-1 visa involves filing petition forms and establishing eligibility with the USCIS. Once approved, you can apply for the visa. The application requires your fiancé to participate in a visa interview.

After securing the visa and getting married within 90 days, your spouse can apply to become a lawful permanent resident
